Before the WWⅡ,the study of Marxist Jurisprudence in Japan was suppressed by militarism and fell into silence.After the war,the debate of Sociology of law promoted the development of Marxist law,construction of Marxist legal theory system and legal interpretation accelerated the pace of research,and discussion of modern legal issues reached the academic peak.However,the implied defects and relief of social contradictions resulted in its fall to the bottom soon after the peak,and the situation still remains.By sorting out the academic debate,we can see that the reason for the decline of is that it had given up the guiding position of Marxism and misunderstood the national conditions of Japan.Although the results are deplorable,it can show some enlightenment for the development of law with Chinese characteristics.First,Marxist Jurisprudence research should pay close attention to the problems raised by the times;second,legal research must adhere to the guidance of Marxist theory;third,legal research must be carried out in combination with China's national conditions.
