    摘要:

    文化产品是以文化为核心内容、标准化的、可复制化的并能够大规模生产流通的产品。文化产权是指文化产品、文化资源、文化来源、文化企业以及文化相关的财产性权利。文化产品产权价值包括现实价值和潜在价值,是文化产品产权量化的问题,其基础决定性因素是文化效益,直接决定性因素是经济效益,重要影响因素是技术效益,关键制约因素是生态效益;基于“文化-经济-技术-生态”四维效益指标所研发的数智技术评估理论和方法是文化产品产权价值评估的最新探索和尝试。文化产品产权价值实现包括知识产权、文化物权、文化股权以及文化债权等价值实现,也包括时间维度的现实价值和潜在价值实现,还包括路径视角的发行活动和衍生活动等价值实现。

    Abstract:

    Cultural products are standardized, replicable, and mass-produced products with cultural content. Cultural property rights refer to the property rights related to cultural products, cultural resources, cultural origins, cultural enterprises, and other cultural-related properties. The value of cultural product property rights includes both actual and potential value, which refers to quantifying cultural product property rights. Cultural benefit is the basic and decisive factor in the property value of cultural products rights, economic benefit is the direct decisive factor, technological benefit is the important influencing factor, and ecological benefit is the key restrictive factor. The latest theoretical and methodological exploration based on the four-dimension benefit indicators of “culture-economy-technology-ecology” aims at assessing the property value of cultural products. The value realization of cultural product property rights includes that of intellectual property rights, cultural real property rights, cultural equity rights, and cultural creditor’s rights, including realization of real and potential value in the time dimension and value realization of distribution activities and derivative activities.
